In California, what is the length of time for a medical malpractice statute of limitations?

The statute of limitations in California remained at one year for medical malpractice, even though other causes of action for personal injury were recently amended to two years. There are exceptions however if you’ve continued to treat with the health care provider or if you only recently discovered the malpractice. Additionally the statute of limitations are different for children under the age of 8 which grants more time, and on the other hand if the offending party was a government entity, you only have 6 months. As you can see, there are many variables in determining whether a statute of limitations has run and I’d recommend you get in to see a medical malpractice attorney to discuss your claims ASAP.
