To what extent is an injury considered in a criminal charge of assault?

The degree of injury would likely be something the prosecutor would consider in a plea arrangement, or a jury would consider if a trial occurs. One could argue the minimal nature of the victim’s condition. Continue working with a good criminal defense attorney and keep inquiring into the medical condition which is an element of the crime your brother has been charged with. Certainly a good recovery would help prove the minimal nature of the condition.
