Professional Negligence - Failure to Diagnose

Posted Tuesday, May 17, 2011 by Ed Harper

If you feel your medical condition was not diagnosed correctly, you should consult with a professional negligence attorney who can review the medical records. The attorney will also compare what you have told him/her with what the records show. An expert will also have to review the records and provide you with an opinion that the health care professional breached the standard of care and this failure directly led to a worsening of the condition. These failure to diagnose cases are fraught with difficulties – as you likely had the condition when you first went into the ER, if you say the doctor should have caught the problem initially. Thus, the problem is to differentiate the natural results of the condition even if detected early. You can only recover for the difference between what actually happened, compared to what should have happened if detected correctly. Hope this helps.
